Many times adult consumers seeking assistance in CDPAS have their adult parents willing and available to care and assist. However, until recently, parents were not allowed to provide care or assistance for their adult children, even to an adult child living in a separate residence.
The law does not allow a person hired as a CDPAS assistant if he or she is legally responsible for the eligible consumer’s care and support. However, an adult who is not legally responsible for the eligible consumer’s care and support may be a CDPAS assistant for that individual.
The law is for adult children 21 years or older. Parents of children who are younger than 21 years of age cannot be hired as that minor child’s assistant.
A CDPAS spouse or designated representative still remains precluded from being hired as a personal assistant.
